These Website Terms of Use (“Terms”) govern access to and use of the Forklift Management Consulting website at www.forkliftmanagement.co.za, including its pages, content, forms, downloads, images and other public-facing website features (“the Website”).

The Website is owned and operated by Forklift Management Consulting (Pty) Ltd, referred to in these Terms as “FMC”, “we”, “us” or “our”.

By accessing or using the Website, you confirm that you have read, understood and agreed to these Terms. If you do not agree with them, you should discontinue use of the Website.

FMC provides independent, technology-enabled fleet management, oversight, reporting and consulting solutions for forklift, battery and materials-handling operations.

These Terms apply to the public FMC Website and any enquiry, contact or demonstration-request forms made available through it.

They do not replace or override any separate:

  • client service agreement;
  • software subscription or licence agreement;
  • service-level agreement;
  • data-processing or operator agreement;
  • proposal, quotation or statement of work;
  • FMC Fleet Manager platform terms;
  • mobile application terms; or
  • other written agreement concluded with FMC.

Where there is a conflict between these Website Terms and a signed agreement governing paid services or platform access, the signed agreement will apply to that service or access.

The Website provides general information about FMC, its services, technology, capabilities and areas of expertise.

Website content is not intended to constitute:

  • legal, financial, engineering or regulatory advice;
  • equipment-selection or procurement advice for a specific operation;
  • a statutory inspection, load-test certificate or compliance approval;
  • an operational instruction or safety procedure;
  • a substitute for an OEM manual or authorised technical guidance;
  • a guarantee that a fleet, asset, supplier or site is legally compliant;
  • a professional recommendation based on a full assessment of your operation; or
  • an assurance of a particular commercial, operational or financial result.

Decisions involving equipment safety, legal compliance, maintenance, procurement, fleet configuration or operational risk should be based on a proper site-specific assessment and advice from appropriately qualified persons.

FMC provides independent visibility, oversight, technology and decision-support services. The exact nature and scope of FMC’s responsibilities in any client engagement will be determined by the relevant written agreement.

Unless expressly agreed in writing, information on the Website does not mean that FMC:

  • performs equipment maintenance or repairs;
  • dispatches or controls third-party technicians;
  • assumes responsibility for a service provider’s performance;
  • guarantees supplier response or resolution times;
  • certifies statutory or regulatory compliance;
  • assumes responsibility for workplace health and safety;
  • acts as an OEM, dealer, maintenance provider or equipment supplier; or
  • accepts operational liability for a client’s fleet or site.

FMC systems and reports can support oversight and compliance management, but they do not replace inspections, certifications, maintenance obligations or other actions required by law, manufacturers or competent authorities.

Website content is provided for general information and does not constitute a binding offer by FMC.

Submitting a contact form, requesting a demonstration, sending an email or discussing a potential service does not automatically:

  • create a contractual relationship;
  • oblige FMC to provide services;
  • reserve capacity or confirm availability;
  • constitute acceptance of a proposal;
  • guarantee a quoted price; or
  • create an exclusive, agency, partnership or advisory relationship.

A binding service arrangement will arise only when the relevant proposal, quotation, agreement or other written document has been accepted in accordance with its terms.

FMC takes reasonable care to ensure that Website content is clear and accurate. However, fleet-management practices, technology features, legislation, regulations, industry standards and service offerings may change.

FMC does not warrant that every item of Website content will always be:

  • complete;
  • current;
  • error-free;
  • suitable for a particular operation; or
  • available in every location or client engagement.

FMC may correct, update, expand, remove or replace Website content without prior notice.

If information is important to a commercial or operational decision, you should ask FMC to confirm it in writing.

Images, videos, dashboards, reports, device mock-ups and platform screenshots displayed on the Website are provided for illustration and demonstration.

Actual platform appearance, functionality, terminology, modules and reports may differ depending on:

  • the user’s access level;
  • selected modules;
  • client configuration;
  • data availability;
  • development updates;
  • device type; and
  • the applicable service agreement.

References to cost control, improved visibility, accountability, uptime, compliance readiness or operational improvement describe intended benefits. They do not constitute guaranteed outcomes.

Actual results depend on factors including data quality, client participation, supplier performance, fleet condition, operational practices and implementation.

You may use the Website only for lawful purposes and in a manner that does not interfere with its operation or the rights of FMC or any other person.

You may not:

  • use the Website for unlawful, fraudulent or misleading purposes;
  • attempt to gain unauthorised access to any account, platform, server, database or restricted area;
  • test, scan or probe the Website for vulnerabilities without written permission;
  • introduce malware, viruses, malicious code or harmful technology;
  • disrupt, overload or interfere with the Website or its supporting infrastructure;
  • impersonate another person or misrepresent your identity or authority;

These links are provided for convenience or information. FMC does not control and is not responsible for:

  • external website content;
  • third-party availability or security;
  • products or services offered by third parties;
  • third-party privacy practices; or
  • loss arising from the use of an external website or service.

Access to third-party websites is at your own discretion and may be subject to separate terms and privacy policies.

FMC takes reasonable steps to maintain the Website and protect it against foreseeable security risks. However, FMC does not guarantee that the Website will always be:

  • uninterrupted or continuously available;
  • free from errors or technical faults;
  • compatible with every browser or device;
  • free from malicious code introduced by third parties; or
  • immune from events outside FMC’s reasonable control.

  • liability that may not be limited under the Consumer Protection Act or another applicable law; or
  • liability for fraud, wilful misconduct or gross negligence where such liability cannot lawfully be excluded.

To the extent permitted by law, you agree to indemnify FMC against third-party claims, losses, liabilities or reasonable costs resulting from:

  • your unlawful use of the Website;
  • your material breach of these Terms;
  • information you submit without proper authority;
  • your infringement of another person’s intellectual-property or privacy rights; or
  • malicious interference with the Website or its infrastructure.

This provision does not apply to loss caused by FMC’s own unlawful conduct or to liability that may not lawfully be excluded.

Use of the Website is also subject to FMC’s:

These documents explain how FMC collects and processes personal information and how cookies and similar technologies may be used.

When you communicate with FMC electronically, you consent to receiving responses and related communications electronically or through your selected contact method.

An email or electronic message will not be treated as a binding acceptance of contractual terms unless it clearly records that acceptance or the applicable agreement allows electronic acceptance.

Changes will apply from the date of publication. Continued use of the Website after publication means that you accept the updated Terms.

Changes to these Website Terms will not automatically amend a signed client or service agreement.

These Terms are governed by the laws of the Republic of South Africa.

Any dispute relating to the Website or these Terms will be subject to the jurisdiction of a competent South African court, without limiting any statutory right you may have to approach a regulator, tribunal, ombud or other authorised forum.

Before commencing formal proceedings, the parties should attempt in good faith to resolve the dispute through written communication.

If any provision of these Terms is found to be invalid, unlawful or unenforceable, that provision will be interpreted or limited to the minimum extent necessary.

The remaining provisions will continue to apply.

A failure or delay by FMC in enforcing any provision of these Terms does not constitute a waiver of that provision or any other right.
